1. WHAT IS MYHEREDIA
1.1 Service Definition
MyHeredia is a digital platform that allows users to:
- Store encrypted instructions, documents, and messages intended for designated individuals (hereinafter "Beneficiaries")
- Configure automatic activation mechanisms based on inactivity ("Dead Man's Switch")
- Transmit the stored instructions to Beneficiaries in case of the User's death or incapacity
1.2 Service Nature
MyHeredia is a technical facilitator, NOT a:
- ❌ Law firm or notary office
- ❌ Executor of a will
- ❌ Financial or inheritance advisor
- ❌ Guarantor of instruction execution by third parties
Instructions stored on MyHeredia have the status of a private document and do not replace a holographic or public will for the legal succession of estate assets.
2. ACCEPTANCE OF TERMS
By using MyHeredia, the User declares to:
- Have read and fully understood these Terms
- Be at least 18 years of age
- Be legally capable of disposing of their digital data and assets
- Expressly accept the liability limitation clauses in Art. 7
3. SERVICE DESCRIPTION
3.1 Included Features
The one-time payment entitles you to:
- Encrypted Vault: Secure storage of instructions, documents, and messages
- Beneficiary Designation: Configuration of individuals who will receive instructions only upon the occurrence of configured conditions
- Dead Man's Switch: Periodic activity checks and automatic activation in case of prolonged inactivity
- Shamir's Secret Sharing: Cryptographic splitting of access keys among multiple trusted contacts
- Technical Support: Email assistance for [10] years from the date of purchase
3.2 What is NOT Included
- ❌ Storage beyond [10] years from the date of purchase (unless renewed)
- ❌ Legal, notary, or inheritance consultancy services
- ❌ Guarantee that third parties (Google, Facebook, banks, exchanges) will execute instructions
- ❌ Physical execution of instructions (contacting providers, transferring assets, etc.)
- ❌ Mediation in disputes between heirs or beneficiaries
4. USER OBLIGATIONS AND RESPONSIBILITIES
4.1 Truthfulness of Information
The User guarantees that:
- The inserted instructions express their free and conscious will
- Uploaded documents are authentic and lawful
- Beneficiary emails are correct and belong to truly designated persons
- They have the legal right to dispose of the assets indicated in the instructions
4.2 Clarity of Instructions
The User is solely responsible for:
- Drafting clear, complete, and non-ambiguous instructions
- Verifying that digital addresses, accounts, and references are correct
- Communicating to Beneficiaries (while alive) the existence of a MyHeredia vault, even without revealing its content
- Integrating digital instructions with a holographic or public will for estate aspects
5. PAYMENT AND PRICE
The service is offered with a one-time payment. Prices are in Euro (EUR) and include VAT if applicable. The payment includes perpetual access for the purchased account and data storage for 10 years.
6. PRIVACY AND ENCRYPTION
6.1 Zero-Knowledge Architecture
MyHeredia uses a zero-knowledge architecture: User data is encrypted client-side before being sent to servers. MyHeredia cannot access vault content.
7. LIMITATION OF LIABILITY ⚠️
MyHeredia DOES NOT guarantee execution by third parties. Each provider (social networks, banks, etc.) has autonomous post-mortem access policies. MyHeredia's total liability is limited to the amount paid for the service.

2. TYPES OF DATA PROCESSED
We process personal data (Name, email), access data (hashed passwords, logs), and encrypted Vault content (not accessible to us).
3. PURPOSES AND LEGAL BASIS

4. SECURITY MEASURES
We use End-to-End encryption (Zero-Knowledge), TLS 1.3, and encrypted PostgreSQL storage.
5. DATA SUBPROCESSORS
Data is stored in the EU (DigitalOcean, Frankfurt). We use Cloudflare for security and SendGrid for emails.
6. YOUR RIGHTS
You have the right to access, rectify, and erase your data, and the right to data portability. You can exercise these rights directly from your Dashboard.
